Jack Smith could write a damning report about Donald Trump's election-fraud case before resigning, a former federal prosecutor has said.

Sahar Abi-Hassan, assistant political science professor at Northeastern University in Oakland, California, told Newsweek that Special Counsel Smith will likely write a final report and resign.

Trump was indicted on four counts of allegedly working to illegally interfere in the results of the 2020 election in the run-up to the January 6, 2021 riot at the U.S. Capitol. The president-elect has pleaded not guilty and has said the case is part of a political witch hunt. He accused Smith of attempting to interfere in the 2024 presidential election by prosecuting him. Newsweek sought email comment from the Trump campaign on Thursday.

"The justice department has a policy that prohibits the prosecution of a sitting president. So, I believe the most likely scenario is Smith winding down his investigation, releasing a report, and ultimately resigning," Abi-Hassan said.

"It is not a good look for anyone, including Smith, to get fired. I feel like resigning may be a more graceful exit for Smith, and that way at least he gets to share his findings."

Smith is expected to resign as special counsel in Donald Trump's election-fraud case in Washington, D.C.

Under Department of Justice rules, sitting presidents cannot be prosecuted, which would push the case back to 2029.

However, Trump has already vowed to have Smith immediately fired as soon as the Republican takes office in January 2025.


Joyce Vance, a frequent Trump critic, wrote on her Civil Discourse legal blog on Wednesday that Smith's report could leave a permanent record of Trump's attempt to overturn the result of the 2020 election. Vance wrote that she doesn't know what value the Smith report would serve, except to leave a record of the case.

"It's hard to assess what value a report like that might have, beyond information and evidence Smith's court filings have already made public," Vance wrote.

"It would at least guarantee there would be a permanent public record that would survive Trump's certain demand that the Justice Department kill the cases against him. This is one potentially intriguing possibility in a day that didn't have much optimism to offer," she added.

Vance said that, despite the prospect of a Smith report, she is disappointed that Trump has escaped justice.

"It bothers me deeply, nonetheless, that Trump has avoided accountability at the hands of a jury that would consider the evidence against him and decide whether to convict him or not. I know I'll struggle with that for a long time."
